この第一審において、地裁は、Laryngeal Mask Co.の特許における下記クレーム1の“at least a portion of the posterior portion of a wall of the cuff in the distal region being thicker and stiffer than other portions of the cuff、”の文言が、明細書中に適切に記述されておらず、記述要件違反であるとして、無効との判断を示した。

原告のLaryngeal Mask Co.は、Ambuの製品が自己の特許権(US7,156,100)を侵害するとして、カリフォルニア州南部地区地裁に訴えを提起した。
この第一審において、地裁は、Laryngeal Mask Co.の特許における下記クレーム1の“at least a portion of the posterior portion of a wall of the cuff in the distal region being thicker and stiffer than other portions of the cuff、”の文言が、明細書中に適切に記述されておらず、記述要件違反であるとして、無効との判断を示した。

CAFCは、本件発明の要旨は、カフの補強のためには、カフが背板に接合されていることを要するというものではなく、むしろ補強具がカフの末端部に組み込まれていることが記載されていると認定した。また、好ましい態様として、補強具が背板から伸びていることが述べられているとも認定した。
その上で、CAFCは、当業者であれば、背板への接合を要することなく、末端にカフの補強具が組み込まれていることが、開示内容から読み取れると判断した。更に、背板に接合しなくても、厚くしたカフが開示されていることが読み取れると判断した。 その結果、CAFCは地裁の判決を破棄し、差し戻した。
